ConLoot Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and ConLoot, Inc. (“ConLoot,” “we,” “us”) governing your use of the ConLoot mobile application on iOS and Android (the “App”) and any associated websites and services (together with the App, the “Service”).
By creating an account, signing in, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Acceptance
These Terms incorporate by reference our Privacy Policy. Together they form the entire agreement between you and ConLoot regarding the Service. We may update these Terms from time to time as described in Section 13.
2. Eligibility
You must be at least 13 years old to use the Service. If you are between 13 and the age of majority where you live, you must have a parent or legal guardian’s permission to use the Service, and they must agree to these Terms on your behalf.
The Service is not directed to children under 13. If you are under 13, do not use the Service.
3. Your account
You are responsible for:
- Providing accurate sign-up information (a working email address).
- Keeping your password confidential.
- All activity that occurs under your account, whether or not you authorised it.
Notify us immediately at [email protected] if you believe your account has been compromised. We are not liable for losses you incur from unauthorised account access caused by your failure to safeguard your credentials.
You may delete your account at any time from the Account tab inside the App. Deletion removes your lists, follows, and push tokens as described in our Privacy Policy.
4. User content
The Service lets you create lists, follow vendors, and set profile details such as a display name and username. Anything you submit through the Service — your list names and contents, and your profile details — is “User Content.”
4.1 You retain ownership
You keep all rights you have in your User Content. We do not claim ownership of your list contents or your profile details.
4.2 Licence you grant us
By submitting User Content, you grant ConLoot a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, reproduce, display, distribute, and adapt that content solely for the purpose of operating and improving the Service (for example, syncing your lists across your devices). This licence ends when you delete the content or your account, except to the extent that we are legally required to retain it.
4.3 Your representations
You represent and warrant that:
- You own or have all necessary rights in the User Content you submit.
- Your User Content does not infringe any third party’s intellectual-property rights, privacy rights, or publicity rights.
- Your User Content complies with the Acceptable Use rules in Section 5.
4.4 Moderation
We may, but are not obligated to, review, remove, or refuse User Content for any reason, including suspected infringement or violation of these Terms. We are not responsible for the accuracy of User Content.
5. Acceptable Use
You agree NOT to use the Service to:
- Scrape, crawl, or harvest content from the Service by automated means without our prior written consent.
- Coordinate scalping or resale schemes that violate the rules of any convention, vendor, or licence holder. The Service is for collectors, not for organising mass-buy operations.
- Harass, threaten, or defame vendors, convention staff, other users, or any other person.
- Upload infringing, defamatory, obscene, sexually explicit, hateful, or unlawful content.
- Impersonate another person, vendor, or organisation.
- Submit false or deliberately misleading information.
- Reverse-engineer, decompile, or attempt to derive source code from the App, except to the extent applicable law forbids that restriction.
- Interfere with the Service, including by introducing malware, overloading servers, or bypassing authentication or rate limits.
- Use the Service to violate any law or the rights of any person.
We may suspend or terminate accounts that violate these rules. Repeat infringers will be terminated and may be reported to the appropriate authorities.
6. Third-party content and conventions
6.1 Vendor, convention, and product information
The Service surfaces information about conventions (for example, San Diego Comic-Con), vendors, booths, and collectibles. This information is gathered from publicly available sources (vendor announcements, blog posts, social media, retailer pages) and from user submissions. It is provided “as-is” and may be inaccurate, out of date, or incomplete.
ConLoot is not affiliated with, endorsed by, or sponsored by any convention, vendor, intellectual-property holder, or licensee referenced in the Service. References to third-party names, trademarks, products, and exclusives are for identification purposes only and remain the property of their respective owners.
6.2 eBay comp data
Recent sale prices and active listings labelled as “eBay” are fetched server-side from public eBay APIs and cached. We do our best to keep them accurate, but they may be delayed, partial, or wrong, and they should not be treated as financial advice. Do not make purchasing decisions on the assumption that displayed prices are real-time.
6.3 Booth numbers, edition counts, and availability
Booth numbers, edition counts, and exclusivity tags are educated estimates compiled from public sources. Conventions and vendors change these without notice. ConLoot is not responsible for items that are sold out, moved to a different booth, or otherwise unavailable when you arrive.
7. Affiliate disclosure
Some outbound links to eBay listings include eBay Partner Network affiliate tags. If you purchase an item through one of those links, ConLoot may receive a small commission at no additional cost to you. We disclose this so you can make informed decisions about which links to follow. Affiliate participation does not influence which listings or comps the Service surfaces.
8. Intellectual property in the Service
The Service itself, including the App’s source code, user interface, design system, written copy, logos, and marketing materials, is owned by ConLoot, Inc. and protected by copyright, trademark, and other intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms. No other rights are granted.

9. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, if we are required to do so by law, or if continued operation of the Service to you would expose us to legal or operational risk. Sections 4.2 (licence), 6 through 13, and any provision that by its nature should survive termination, will survive.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
WITHOUT LIMITING THE FOREGOING, ConLoot DOES NOT WARRANT THAT:
- PRICES, BOOTH NUMBERS, EDITION COUNTS, OR EXCLUSIVITY DESIGNATIONS WILL BE ACCURATE;
- THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE;
- ANY ERRORS IN THE SERVICE WILL BE CORRECTED.
YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ConLoot AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID ConLoot IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 50.
Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.
12. Governing law and disputes
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service that is not resolved informally will be brought exclusively in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction in those courts. Nothing in this section prevents either party from seeking injunctive relief in any court of competent jurisdiction.
If you are a consumer based in the EEA or UK, you may also have the right to bring proceedings in the courts of the country where you live; this section does not deprive you of any mandatory consumer protections.
13. Changes to these Terms
We may revise these Terms from time to time. If a change is material, we will notify you in the App on next launch and update the “Last updated” date above. Continued use of the Service after the change becomes effective constitutes acceptance of the revised Terms. If you do not agree, stop using the Service and delete your account.
14. Miscellaneous
- Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force.
- No waiver. Our failure to enforce any provision is not a waiver of that provision.
- Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Apple-specific terms. If you downloaded the App from the Apple App Store, you acknowledge that these Terms are between you and ConLoot, not Apple, and that Apple has no obligation to provide maintenance or support. Apple is a third-party beneficiary of these Terms with the right to enforce them against you.
- Google-specific terms. If you downloaded the App from Google Play, your use is also subject to the Google Play Terms of Service.
